એવું કહેવાય છે કે માથાના વાળ તેટલા કાયદા! આવી ગુંચવણભરી પરિસ્થિતીને સમજવા માટે અને ખાસ તો કાયદા અને બંધારણનું વાસ્તવિક સ્વરુપ જાણવા માટે ૨૫ વર્ષથી આ ક્ષેત્રે કાર્યરત સિનિયર એડવોકેટ આર. કે. પટેલનો ઇન્ટરવ્યુ કરવાનું થયુ અને એક સામાન્ય વ્યક્તિ તરીકે આપણે માની ના શકીએ તેવી બાબતો વિશે ખ્યાલ આવ્યો.
આ ઇન્ટરવ્યુથી એક સામાન્ય માણસને સમાજમાં પ્રવર્તિત અને લાગુ પડતી કેટલીય બાબતો વિશે ઉજાસ થશે. દરેક બાબતોમાં બે એંગલ્સ છે… પહેલો એંગલ એ કે જે તે મુદા વિશે કાયદો શું કહે છે અને બીજો એંગલ એ કે જ્યુડિશિયલ સિસ્ટમમાં વાસ્તવિકતા શું છે. તે જાણીને ખરેખર દંગ રહી જવાય તેવી વાત છે.
ઇન્ટરવ્યુના અંશો:
- કેટલાય કાયદાઓ ડેડ છે, અર્થાત બંધારણમાં તો છે પરંતુ તેનું પાલન લગભગ ક્યાય થતુ જોવા મળતુ નથી.
- ૮૦% આરોપીઓ પુરાવાના અભાવે છુટી જતા હોય છે.
- પહેલા એવું કહેવાતુ કે ભલે ૧૦૦ આરોપીઓ છુટી જાય પરંતુ એક નિર્દોષને સજા ન થવી જોઇએ. શું આ વાક્ય હાલનાં સમયમાં પણ લાગુ કરી શકાય? અને લાગુ કરવા જઇએ તો તેની અસરો શું હોઇ શકે?
- લોકો ઓન ઓથ ખોટુ બોલવાથી ટેવાઇ ગયા છે.
- હાર સામાન્ય નાગરિકની થતી હોય છે.
- કાયદો તો લોઅર ક્લાસ, લોઅર મિડલ ક્લાસ અને મિડલ ક્લાસ માટે છે… રીચ ક્લાસ માટે નથી!
- છુટાછેડાનું પ્રમાણ ભયજનક રીતે વધી ગયું છે.
- મહતમ કાયદાઓ સ્ત્રીની તરફેણમાં છે. પુરુષની તરફેણ કરતો એક કાયદો હોવો જોઇએ.
- છુટાછેડામાં એપ્લિકન્ટ હસબન્ડ છે તો કેસ ૮થી ૧૦ વર્ષ સુધી ચાલતો હોય છે પરંતુ જો એપ્લિકન્ટ વાઇફ છે તો ૨થી ૩ વર્ષમાં ચુકાદો આવી જતો હોય છે.
- એકવાર ફેમિલી કોર્ટ બે કલાક બેસતા આવો એમ જ એટલે વાસ્તવિકતાનો ખ્યાલ આવશે.
- ભરણપોષણનાં ચોક્કસ નિયમો તો છે જ, પરંતુ તેનું પાલન એટલુ થતુ નથી.
- શક્ય હોય ત્યા સુધી કોર્ટ કેસ કરવો જ નહી. તેના સિવાયના રસ્તાઓથી સમાધાન મેળવવા પ્રયાસો કરવા.
- સુપ્રિમ કોર્ટની ગાઇડલાઇન્સ.
- પોલિસ કે સરકારી અધિકારીઓનું જે-તે કચેરીમાં વિડિયો રેકોર્ડિંગ કરવા માટે કાનુની પ્રાવધાન શું છે?
- પુખ્ત ઉંમરનું કપલ જેના મેરેજ નથી થયા તો તેઓ હોટલમાં રુમ ભાડે રાખી શકે છે? તેવામાં પોલિસ રેડ પાડે તો કાનુની જોગવાઇ શું છે?
- બગીચામાં કપલ બેસે તેને લગત કાનુની જોગવાઇ શું કહે છે?
- ૧લી જુલાઇ ૨૦૨૪થી ૩ નવા કાયદા આવી રહ્યા છે, તે શું છે?
- કોર્ટ-કચેરી-કેસમાં વકિલોનો રોલ કેવો હોય છે?
